By accessing or using the Greenfield Memorial platform ("Service") at greenfieldmemorial.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and funeral home subscribers.
Greenfield Memorial provides cloud-based funeral home management software, including case management, scheduling, family portal access, memorial page publishing, and integrated payment processing. Features are offered on a subscription basis to licensed funeral home operators and their authorized staff.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@greenfieldmemorial.com if you suspect unauthorized access.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
The Service integrates with third-party payment processors (currently Clover) to facilitate payment collection by funeral homes from families. Greenfield Memorial is not a party to any payment transaction between a funeral home and its clients. Payment processing fees are charged by the payment processor and are the responsibility of the funeral home. Greenfield Memorial is not responsible for payment processor errors, outages, or disputes.
By providing a phone number and opting in to SMS notifications, you consent to receive automated text messages from Greenfield Memorial related to your account and service activity. Message and data rates may apply. You may opt out at any time by replying STOP. See our Privacy Policy for details.
All content, software, trademarks, and materials on the Service are the property of Greenfield Memorial or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials without prior written consent.
You retain ownership of content you upload to the Service (case records, photos, obituaries, etc.). By uploading content, you grant Greenfield Memorial a limited, non-exclusive license to store, display, and process that content solely to provide the Service. You represent that you have all necessary rights to the content you upload.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. To the extent your use of the Service involves Protected Health Information ("PHI") as defined under HIPAA, you agree to execute a Business Associate Agreement ("BAA") with Greenfield Memorial prior to transmitting any such information through the platform.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREENFIELD MEMORIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Greenfield Memorial and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate a subscription at any time. We may also suspend or terminate your access for violations of these Terms or for non-payment, with reasonable notice where practicable.
Upon cancellation — whether voluntary or due to non-payment — Greenfield Memorial will provide you with an export of your data in the form of a SQL export from all data tables associated with your account upon written request to support@greenfieldmemorial.com. Data export requests will be fulfilled within 30 days of the termination date. After 90 days following termination, we reserve the right to delete your data from our systems.
Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts located in Florida.
We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes your acceptance.
